McNaughten Village Condominium Association

Ref: Spring Clean Up

Dear Residents,

This letter is going out to all residents in the McNaughten Village Condominium Association.  The Association has a web site where the association’s document can be found.  The web site for the Associations is www.McNaughtenVillage.com.

Spring is upon us and it is time to clean up around the community.  There are many patio fences and interiors of the patios that are in need of repair and clean up.  The Board of Directors is requesting that all patio areas, limited common area, plantings, etc. be cleaned up prior to April 27, 2018.  This will give you plenty of notice to have this completed.  After that date the association will have any violations cleaned up at the home owner’s expense.  If you have any questions, please contact this office.

As stated in the bylaws and rules and regulations, the doors and garage doors are an owner responsibility.  There are several doors and garage doors that are in need of repair and or replacement.  This becomes a violation if not maintained.  Please have these doors and garage doors repaired/painted and or replaced prior to April 27, 2018.  If it cannot be done by that date, please have a plan submitted to the Board of Directors prior to that date, so it can be reviewed and approved.

We have noticed that there are a couple of vehicles that are either parked for extended periods of time or are being worked on.  These are violations of the rules and regulations.  Do not work on vehicles in the common area.  Also do not park a vehicle in the common area for more than 48 hours without the prior approval of the Board of Directors.  Violators are subject to be towed at the owner’s expense.

Please notify the management company should you see any exterior repairs that are needed.  You can either e-mail me at tom@advancedrealty/mgmt.com or drop a note off at Joanne Kitchen’s, 1862 Misty Way.

As a reminder, I have included some of the Association rules that deal with the owner responsibility.  Please review.

Limited Common Areas

Limited Common Areas, as described in the Bylaws, means those Common Areas serving exclusively one Unit or more than one but less than all Units, the enjoyment, benefit or use of which are reserved to the lawful occupants of that Unit or Units either in the Bylaws, or by the Board, and is that portion of the Condominium Property constituting “limited common areas and facilities” of the Condominium under the Condominium Act.

Limited Common Areas Uses:  Limited Common areas consist of a front concrete stoop and the patio area and existing fences at the rear of each unit and the improvements inside of the patio.  These areas are reserved for the exclusive use of the Unit owner and occupants of the Unit.  The Unit owner is responsible for cleaning, moving, plowing or ice removal of the stoops and patios.  It is the Unit owner’s responsibility to repair or maintain improvements within the patio and the interior surface of the patio fences, and to remove snow from the sidewalks. (Remove snow from sidewalks when it exceeds 2” in depth.)

When an owner removes a fence for any reason, they shall be held responsible for replacing said fence prior to the sale of the unit.

IV.    Decorative Items

C.    The American Flag
The American Flag may be flown or displayed at anytime following normal flag protocol.

D.     Structural Integrity
Nothing can be done in any Unit that impairs or changes the structural integrity of the Unit.

E.    Flower Pots
Flower Pots must be placed in the mulched areas with the exception of (1) pot being allowed on the porch. They are not to be placed on the sidewalk or on the driveway.

F.    Vegetable Plants – Are not permitted in any outside area or surface, other than the owner’s patio.

V.    Flowers/Landscape Plants

A.    Flowers
Flowers may be planted inside the patio fence or existing mulched area.  Maintenance of the flowers is the responsibility of the resident and dead annuals are to be removed at the end of the season.  The landscape company will remove annuals that are not maintained during the growing season and the cost for removal will be billed to the resident.

B.    Landscape Plants
  1. Planting of new shrubs outside the patio fence must receive advanced approval.
  2. Additional landscape plants may be considered will be of a species already in use in the community and which; at maturity will not exceed the height of the patio fence.  Nothing is to creep over the fencing.
  3. Any new planting beds will be limited in size by the Board of Directors.

XI.    Parking/Vehicles

A.    The Board may pass rules and regulations restricting or prohibiting parking.  Here is a summary of the parking rules:
  1. Since Misty Way is a private street belonging to the Association, no person or guest shall drive a motor vehicle on the street in reckless violation of any posted or un-posted restrictions.  Little Brook Way, being a city street, is subject to street restrictions of the City of Columbus.  The speed limit on Misty Way is 10 M.P.H.
  2. No person shall park a motor vehicle on Misty Way except under special permission of the Board.
  3. No person shall stop or park any motor vehicle on Misty Way or in a common driveway in such a manner as to obstruct vehicles access to or from said street or driveway, common green area or parking area.
  4. No person shall park a disabled or inoperative vehicle nor perform mechanical work on a vehicle on any Association street or driveway, common green area or parking area.
  5. No person shall park a boat, truck, trailer, or recreational vehicle on any Association street or driveway or parking area for more than 48 hours without prior written approval of the Board (Revised 2006)
  6. Inoperable vehicles (with flat tires, expired license tags, etc), which cannot be identified as belonging to a resident, or vehicles involved in any illegal activity which are parked in any common or limited common area for more that forty-eight (48) consecutive hours may be towed off the premises at the vehicle owner’s expense (Revised 2006)
  7. See “Penalty & Enforcement Fee” section for enforcement procedures.  The Board also has the right to have vehicles towed, or to take such other actions as it, in its sole discretion, deems appropriate (See Article III, Section 2(f) of the Declaration and By-Laws).

XIX.    Patios

  • Patios are to be kept clean and free of debris.  All patios are to be cleaned by the Unit owner by June 1st of each year.
  • Those patios out of compliance are referred to on page 9 (decisions and sanctions).

XX.    Quiet Time

  • No excessive noise – stereos, TV’s, construction, etc. – after 11:00 p.m. weekdays, 8:00 a.m. weekends.
  • Children under the age of 18 are to be supervised by a parent, guardian, or other responsible adult after curfew in accordance with the City of Columbus and Franklin County curfew ordinances.

Director Meeting Minutes

Call meeting to order
  • Joanne Kitchen called the meeting to order at 11:01 AM

Establish Quorum
  • Board members Joanne Kitchen, Robert Jackson, Sandra Matthews, Nancy West and Judie Brenneman were present.  Joey Ashbrook was absent due to illness.
  • Bill Emery was a guest who was present.

Election of Officers
  • Joanne Kitchen was nominated for President, Sandra Matthews was nominated for Secretary and Nancy West was nominated for Treasurer.
  • A motion was made by Sandra Matthews to approve these nominations.  This motion was seconded by Nancy West and approved by all.

Reviewed the meeting minutes from February 26, 2018.
  • A motion was made by Sandra Matthews to approve the minutes as read.  This motion was seconded by nancy West and approved by all.

Property Managers Report as of March 23, 2018
  • As of this date you have $12,869.76 in your checking account.
  • As of this date you have $150,659.37 in your savings account.
  • As of this date you have $11,540.73 in your CD account.
  • There are two owners who currently owe the association money.
  • One is in foreclosure.

Old Business
  • The curb and sod repair damage created by the snow plows will take place in the spring.
  • The gutters had been cleaned and Virgin Landscape is currently on site doing the spring clean up.
  • Waiting on a proposal from Rescue Roofing for 1860-1862 Misty Way roof.
  • Carlton Harris has been contacted to go back out to 1817/1819 Misty Way to level the dirt.
  • The drain is sticking out of the ground at 1811 Misty Way and will be repaired.
  • Virgin Landscape has been asked to pick up the blocks that are out front of 1818 Misty Way.
  • Rob Adkins is to give a proposal to clear and run a new drain line in front of the shed.

New Business
  • The Board will be reviewing the rules and regulations to determine if any changes are needed.
  • A letter has been sent to 5992 Little Brook regarding their door needing painted.
  • Robert Jackson would like the agenda to be sent out prior to the meeting date if possible.
  • The Board wants a mass letter sent out to all owners regarding cleaning up their patios, removing ornaments and other items from the front yards and walls.  Painting and or repairing their front doors and garage doors.

General Discussion
  • The next meeting is will be on April 23, 2018.

Adjourn Meeting
  • A motion was made by Nancy West to adjourn the meeting at 12:13PM.  This motion was seconded by Sandra Matthews and approved by all.

Sex Offender Notice

I found this notice in my mail yesterday, and I thought it was worth posting.  There is a new sex offender living near our neighborhood.

The image doesn't scan too well, so I got a little curious and went out to the Franklin County Sheriff's site.  I was startled at what I found.

We have five sex offenders living in our area.  Here's a list from the same site, including our new arrival.


All of these criminals are living close by, within one-half mile if the map is correct.  More information is available at the Franklin County Sheriff's Office.
